Terms & Project Policy

Introduction

This policy outlines the terms and expectations for all services provided by Z Schwartz Design. It ensures clarity, alignment, and a smooth creative process for both parties. By engaging in services, the client agrees to the terms below.

Scope of Work

All services are performed according to the approved proposal or written agreement. The scope includes only the deliverables clearly outlined in that agreement.

Any additional requests, expanded deliverables, new concepts, or work beyond the agreed scope will be billed separately at the standard hourly rate or quoted accordingly.

Retainer & Payment Terms

  • A non-refundable retainer is required to secure your project and reserve time in the schedule.

  • Work will not begin until the retainer payment is received.

  • Remaining balances must be paid according to the schedule outlined in the proposal.

  • Final deliverables will not be released until all outstanding invoices are paid in full.

  • Late payments may result in paused work and timeline extensions.

Revisions

Revisions are included as specified in the proposal. Revisions apply to refinements of the selected concept only.

Requests for new directions, significant changes after approval, or expanded creative exploration will be treated as additional work and billed accordingly.

Timeline & Client Responsibilities

Timelines depend on prompt communication and timely delivery of required materials, feedback, and approvals.

Delays in client response, content submission, or payments may extend the project timeline.

If a project remains inactive for 30 days due to client delay, it may be paused and rescheduled based on availability.

Ownership & Usage Rights

Upon full payment, the client receives ownership of the final approved deliverables.

All unused concepts, drafts, alternate directions, working files, and preliminary materials remain the intellectual property of Z Schwartz Design and may not be used or reproduced without written consent.

Z Schwartz Design reserves the right to showcase completed work in its portfolio, marketing materials, and social platforms.

File Delivery

Final files will be delivered in formats suitable for digital and print use as outlined in the proposal.

Editable or open-source working files (Illustrator, InDesign, Figma, etc.) are not included unless explicitly stated and may require an additional fee.

Printing & Production

Z Schwartz Design is not responsible for printing errors, color shifts, manufacturing issues, or vendor mistakes once final files have been approved and released.

Clients are responsible for thoroughly reviewing all final proofs before print or production approval.

Website & Digital Projects

For web-based projects:

  • Clients are responsible for domain, hosting, and third-party platform fees unless otherwise agreed.

  • Ongoing maintenance, updates, or technical support are not included unless under a separate agreement.

  • Platform limitations, outages, or third-party software changes are not the responsibility of Z Schwartz Design.

Cancellations

If a project is canceled after work has begun:

  • The retainer remains non-refundable.

  • Any work completed beyond the retainer value will be invoiced accordingly.

Limitation of Liability

Z Schwartz Design shall not be held liable for indirect losses, business interruption, or third-party issues arising from the use of delivered materials.
